RE: The tariff classification of infant’s swaddling from China.

Dear Ms. Sberna:

In your letter dated May 15, 2013, on behalf of Gold, Inc., you requested a tariff classification ruling. As requested, the samples will be returned to you.

You have submitted two samples. The first sample, Style WS13-4040GZ-C which is described as infant’s swaddling is a one piece baby bunting. The item is constructed of 93% cotton, 7% spandex finely knit jersey fabric. It has a full front ruffled zipper opening that extends from the round self-capped neckline towards the garment bottom. The article is sized for babies in small, medium and large. The second sample, Style TRA-S14-11112-010 is an infant’s swaddling. The item is constructed from 100% rayon printed knit fabric. The left and right upper body sections overlap, criss-cross in the front and are secured by hook and loop tab fasteners at the chest and top of the pouch to secure the article closed. The article is sized for babies in small, medium and large.

The applicable subheading for Style WS13-4040GZ-C will be 6111.20.6070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted: of cotton: other: other, other: other. The rate of duty will be 8.1 percent ad valorem.

The applicable subheading for Style TRA-S14-11112-010 will be 6111.90.5070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted: of other textile materials: of artificial fibers: other, other: other. The rate of duty will be 14.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
